So much emphasis is placed on ensuring that we all have a valid will when we die! But isn’t it even more important to know who is going to make decisions about us and our estate while we are still alive!
Since 1998 Queensland legislation has allowed for appointments of Powers of Attorney which ‘endure’ past the time when a person loses the capacity to make their own decisions, and which can cover ‘lifestyle’ decisions as well as financial decisions. A much better system than the decision-making vacuum it replaced, but a system certainly not immune from abuse.
